Welcome to Naomi Bourque Jewelry. These Terms and Conditions govern your use of our website (https://www.naomibourque.com/) and your purchase of handmade jewelry and artworks. By accessing our site and making a purchase, you agree to be bound by these terms. Please read them carefully.

1. Products & Artisan Nature

1.1 Handmade & Unique Items: All jewelry and objects sold are handcrafted. As each piece is made by hand using natural materials like antler, horn, and hide, no two items are exactly identical. The variations in grain, colour, and shape are inherent characteristics of the materials and are not considered flaws but rather a testament to their authenticity and natural origin.

1.2 Product Descriptions & Imagery: We strive to represent our products as accurately as possible through photographs and descriptions. However, please be aware that the colours and textures you see on your screen may vary slightly due to monitor calibrations. All dimensions and weights provided are approximate.

1.3 Material Sourcing & Ethics: Our materials are sourced from Canada’s Far North, including Caribou and Moose antler, Muskox and Bison horn, and various hides. We are committed to sustainability and ethical practices. Many materials are by-products of traditional and sustainable harvesting practices, honouring the Indigenous principle of using every part of the animal. Please note that some items may contain materials regulated by international treaties such as CITES. Where applicable, these materials are sourced and sold in full compliance with relevant laws.

2. Orders & Payment

2.1 Order Acceptance: All orders are subject to acceptance and product availability. Placing an item in your cart does not reserve it. An order is only confirmed once payment has been processed, and you receive an order confirmation email.

2.2 Pricing: All prices are listed in Canadian Dollars (CAD). We reserve the right to correct any pricing errors that may occur due to system glitches.

2.3 Payment Methods: All payments are secured and encrypted.

2.4 Restocks: Our shop operates on a restock model, with new collections or items often released at specific times (e.g., "Shop Restock 5 PM PST"). Due to the handmade nature of our work, quantities are limited and items may sell out quickly.

3. Shipping Policy

3.1 Shipping Areas:

• Canada: We currently ship across Canada. Canadian Shipping Has Resumed!

• United States: We are NOT shipping to the USA at the moment. This is due to complexities with tariffs and restrictions on shipping items made from certain natural materials. Item descriptions will indicate if they cannot be shipped to the US.

• International: We may, at our discretion, ship to other international locations (including India). Customers outside of Canada must contact us at naomibourque@yahoo.ca before placing an order to confirm if shipping is possible to their country and to understand any additional costs or legal restrictions.

3.2 Shipping Costs & Times (Within Canada):

• We generally ship the next business day after an order is placed.

• We use Canada Post Expedited Tracked service.

• A flat rate of $15 CAD is charged per order.

• Typical Delivery Times:

• BC: 2-3 business days

• Alberta, Saskatchewan, Manitoba: 3-5 business days

• Eastern Provinces, NWT, NU, & Yukon: 5-7 business days

• Local Nelson, BC Area: Free drop-off for purchases is available. Shipping charges will be reimbursed upon delivery confirmation.

3.3 International Shipping (If Applicable): For any international orders we accept, shipping costs, delivery times, and customs clearance are the responsibility of the customer. We cannot guarantee delivery times for international shipments. Any customs duties, import taxes, or brokerage fees are the sole responsibility of the recipient.

3.4 Shipping Delays: We are not liable for delays in shipping caused by carrier issues, weather, holidays, or customs processing.

4. Returns, Exchanges & Refunds

4.1 Artisan Policy: Due to the handmade and personal nature of our jewelry, we generally do not accept returns or exchanges unless the item is damaged or defective upon arrival.

4.2 Damaged or Defective Items: If your item arrives damaged or has a manufacturing defect, you must contact us within 7 days of receiving your order at naomibourque@yahoo.ca. Please include your order number and photographs of the item and its packaging. We will work with you to arrange a repair, replacement, or refund.

4.3 Incorrect Items Shipped: If you receive an incorrect item, please contact us within 7 days, and we will arrange for the correct item to be sent to you upon return of the original.

4.4 Refunds: Refunds for eligible cases will be issued to the original payment method within 14 days of our confirmation of the issue.

We stand behind the craftsmanship of our work. If a piece fails due to a workmanship issue (e.g., a clasp breaks, a setting fails), please contact us to discuss repair options. Repairs needed due to normal wear and tear or accidental damage may be available for a fee.

5. Intellectual Property

All content on this website, including but not limited to designs, text, graphics, logos, images, and product designs, is the intellectual property of Naomi Bourque and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.

6. Limitation of Liability

Naomi Bourque Jewelry shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the site or the products, including any errors or omissions in content, or any loss or damage of any kind incurred as a result of the use of any product or content posted or made available.

7. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.

8. Changes to Terms and Conditions

We reserve the right to update, change, or replace any part of these Terms and Conditions at our sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
